In a recent mail Anthony reminds us what has happened these last 2 years on the legal matter and what is his current situation.
“A couple of years ago one of our supporters and friend, Kristine Hurlen, managed to get the Federal Capital Habeas Unit (CHU) lawyers to come on board as co-counselors and help Todd with my case and file my Petition to the Federal Courts. I was expecting CHU to immediately start investigating. They did not. They simply reviewed Todd's work and rubber stamped it. Unfortunately the Federal Courts denied my Petition/Appeal January 8th 2024.
Two of my strongest claims regarding credible witnesses, George Brown, and former police officer, Malcolm Anthony Gillette (who recanted his trial testimony) were barred due to the Statue of Limitation. The 11th Circuit Court didn't even address the merits of those claims. They said I missed the deadlines to file the Brown related claim by two days and the Gillette claim by one day. The 11th Circuit Court took the position of believing the State's sole so-called witness, Ronald Kirkland's trial testimony despite his criminal record and initially telling a detective he couldn't swear in Court it was me, and initially gave a different description of who he claimed to have seen, and the Florida Supreme Court stating that Brown's testimony does call into question if Ronald Kirkland could have seen Mungin. The Gillette related claim is about someone in law enforcement planting shell casings in the car that the State alleges was involved to incriminate me.
The only way I can get those two strong claims back in Court is to have a lawyer file a Martinez Claim against Todd for missing the deadlines to file those two claims. CHU cannot file the Martinez Claim against Todd because they were co counselor with Todd filing to the Federal Courts. In other words, they cannot file a Martinez Claim against themselves. Some supporters and I have been reaching out to lawyers in Florida to file a Martinez Claim against Todd but none of them would do so because Todd is one of them! And the ones who would take my case wanted $50,000! And I don't have that kind of money. The Martinez Claim is not a hard claim to win especially since the 11th Circuit Court issued an opinion showing how he was late filing the claims. So, at the moment CHU is doing a lot 'talking' but hasn't presented anything to get my case back in Court.
I have no appeals pending. :-( The State of Florida has set a record this year for the most execution in a year and it is only July. Each month in Florida two people are being executed! The State of Florida has executed EIGHT people so far this year and two more are scheduled to be executed with 30 days! I've been reaching out to Innocence Projects but so far none have responded. If I had a lawyer to file the Martinez Claim against Todd I could get my case back in Court. I'm still trying everything I can to get my claims back in court so I will have a new trial to prove my actually innocence.
I'm never going to lose hope nor will I stop fighting for justice.”
