Dans un récent mail Anthony nous rappelle ce qui s'est passé ces 3 dernières années sur le plan légal ainsi que sa situation actuelle.
“A few years ago, my friend and supporter, Kristine, helped me get the Capital Habeas Unit (CHU) out of Tampa, Florida on board to assist the current lawyer, Todd. I assumed they were going to treat my case like a cold case and read through all files, transcripts and documents in search of newly discovered evidence or more evidence to strengthen the claims we already had. Well, they didn't! All they did was read over what Todd was preparing to file to the Federal Courts and basically rubber stamped what he was filing. Fast forward, the Federal Court denied me. Then it gets weird. The Federal Court would not even address two of my most strongest claims because they said they were filed too late! Those claims including a reliable, credible witness that testified that the State's sole witness lied at trial when he identified me. The real witness said that the State's sole witness made up his story. The other claim included a former police officer testified that someone in law enforcement planted shell casings in the alleged car used during the crime in order to incriminate me. Thierry, either one of those claims would have definitely gotten me a new trial! However, the Federal Court refused to address the claims because they said Todd filed the first claim one day late and the other claim two days late. Todd had ample opportunities to file those claims days before the deadline but he did not. So, the ONLY way that I can get those two claims addressed is to file what is called a Martinez Claim against Todd for filing my claims late. I explained this to CHU but the lawyer representing at CHU said CHU can not filed a Martinez Claim on my behalf against Todd because they were co counsel with Todd when he filed it late. In other words, they can't file a Martinez Claim against themselves.
So for a year now I and my daughter and Kristine have been reaching out to innocent projects and pro bono firms to take my case because our French association doesn't have the money to privately retain a lawyer. Some firms we have reached out to showed interest. But before they could take on my case they wanted to speak the lawyer at CHU, Leor. Thierry, Kristine nor I knows exactly what Leor have been telling those that have reached out to him, but after speaking with Leor they have told Kristine that I am in good hands with CHU. Leor has been lying to people because he is trying to protect himself and his friend Todd. That's because he knows if I succeed in a Martinez Claim it will leave a bad mark on him and Todd. CHU is saying they are looking into things like ballistic testing. They want me to ask the Court to reassign Todd to my case to get the ballistic testing done. But if I do that then I waive my rights to file a Martinez Claim and I can never get my two strong claims addressed! I refused to ask the Court to reassign Todd to my case!
I need help getting a lawyer!
